Open Carry Controversy in Racine

RACINE - Racine construction worker Frank Hannan Rock always openly carries his gun at home. In Wisconsin, the open carry of weapons is legal.

"Look at the crime in Racine," Hannan Rock explained. "I do not want to be a victim of a crime. I want to be able to defend myself."

Frank was on his front porch Wednesday night, wearing his gun, when police started questioning him after seeing his weapon. Officers were called to the area for a report of a raccoon being shot.

"I did nothing to provoke them," Hannan Rock said.

Officers repeatedly asked Hannan Rock to give his name, but he refused, citing his 5th Amendment Right. The officers arrested Hannan Rock on obstruction charges and took him to jail, where he spent nine hours.

Racine Police believe Hannan Rock's neighbor made the call about the raccoon shooting to test officers about the Open Carry Law. Police think the entire situation could have been a set up.

"It kind of makes us wonder if this gentleman was trying to set us up as a police agency and see how we were going to react to the open carry situation," Sgt. Bernie Kupper with the Racine Police Department said.

Hannan Rock said it was not a set up, that a neighbor shot the raccoon, and that he was just standing on his front porch legally carrying a gun. He feels he should not have been arrested for refusing to give his name, and said police are targeting people like him because they are against the Open Carry law.

"I'm not the one they have to worry about. We know what the laws are," Hannan Rock said.

Hannan Rock argued with police that he wasn't required to give his name to police. Racine police say when they get a report of shots fired and see a man nearby with a gun, he should at least provide his name to prove he is carrying the weapon legally.

Hannan Rock plans to hire an attorney and fight the obstruction charge.
