WAUKESHA - A judge Friday agreed to freeze the assets of the former doctor accused of killing Jennifer Bukosky, her daughter and unborn child in a traffic accident.
This means Mark Benson's money is essentially locked up for now. The restraining order keeps him from transferring it to anyone else and preserves it for the victims in this lawsuit.
As former surgeon Mark Benson came into court, and the lawyers went back and forth over his money, Michael Buskosky quietly sat in the courtroom.
Buskosky is suing Benson because Benson is charged with killing Bukosky's wife and their unborn baby.
“He's very sad, very upset. This is a very tough time for him,” Bukosky’s Attorney, Robert Habush said.
Friday, Judge Foster barred Benson from making any big financial moves. Attorneys for the victims were concerned he might try to transfer money or property to someone else to keep it away from the lawsuit.
“He cannot dispose of any assets until the next hearing,” Habush said.
Benson is married and has kids. The agreement lets them spend some money to pay bills.
“The agreement is to provide his family and his kids, the opportunity for the necessities in life,” Benson’s car insurance attorney Tom Devine said.
Attorney Habush insists those expenses will be scrutinized to make sure they're not excessive.
What happened in court Friday will not affect Benson’s criminal case. He'll be in court again for that next week.
