ELKHORN - Mark Jensen’s defense plans to wrap up its case Thursday morning.
Wednesday, the judge ruled a defense witnesses has to come back and testify on his own behalf.
Doctor Barry Rumack is a poison expert. The judge says he doesn't have a problem with Rumack's testimony, but with how much he got paid to take the stand.

Wednesday, Forensic Pathologist John Scott Denton backed up Rumack's testimony. Denton has handled dozens of ethylene glycol deaths. Almost all were suicides.
"Out of those 35 deaths that you reviewed, were any of them homicides?"
"We did not find any that were homicides."
Before Denton got on the stand Wednesday, Judge Bruce Schroeder called Rumack's attorney.
Schroeder says Rumack didn't tell the truth about how much he got paid to testify.
Rumack admitted the defense paid him around $5,000 to take the stand, but he failed to mention another $10,000 he was paid.
Now, Rumack will be back on the stand, likely Thursday, to explain why he didn't mention it.
The defense expects to rest their case Thursday morning.
The state plans to call a few rebuttal witnesses.
The jury should begin deliberations Monday or Tuesday.
