Appeal Denied For Teacher Who Viewed Porn

MADISON - A teacher fired after briefly looking at pornography on his school computer will not get his job back anytime soon.

The District 2 Court of Appeals says the Cedarburg School District does not have to reinstate Robert Zellner.

An arbitrator had ordered the district to reinstate the high school science teacher, saying a single immoral act didn't justify his firing. The school district refused.

The appeals court says the arbitrator erred by failing to consider Wisconsin's strong public policy against immoral conduct in schools. The court says the arbitrator exceeded his powers.

Zellner has admitted using his computer to access adult images once in 2005 for about one minute on a Sunday.
