According to a statement from Milwaukee police, the 20-year-old man "reached into his waistband, crouched down and turned toward the officer" just before he was shot.

The man's girlfriend told TODAY'S TMJ4 that he did not have a weapon.

According to the police account, officers were responding to complaints about gunfire in the area when they saw "about 20 men preparing to fight" in a gas station parking lot at 27th and Burleigh.

The men ran from the officers. One officer chased one of the men on foot into the gangway of a home just behind the gas station.

According to police, that's when the man reached into his waistband. "Believing his life was in danger, the officer discharged his weapon, striking the suspect," the police statement said.

Police said the 20-year-old is a known member of the Gangster Disciples gang "and has an arrest record for recklessly endangering safety and burglary."

Detectives searched the area but apparently did not find any weapon.

The 30-year-old officer who fired the shot has been on the force for four years. Police said he has been put on "administrative duty."

The district attorney’s office is investigation the incident.
