FRANKLIN- A man prosecutors say is responsible for causing a multi-vehicle crash in Franklin has been charged.

Police say Abraham Silmi was not paying attention and talking on the phone when he caused a six-car pileup back in August.  Milwaukee County prosecutors charged Silmi with reckless driving, a felony, as court papers indicate he could have avoided the crash.

Henry Palomino was stopped at a red light in another car near 27th and Rawson Ave.

"It happened very quickly. There was a big boom and immediately my car got hit," says Palomino.

Palomino was the fourth car to get rear-ended by the driver who never hit the brakes.

Witnesses apparently saw Silmi driving at "high rate of speed", "going in and out of traffic" talking on a cell and "...raising his hands in air like he was upset."

"It's really upsetting to hear that certainly.  When we drive it's a big responsibility to pay attention to the road," says Palomino.

Palomino went to the hospital and is still in pain -- but a nine-year-old's injuries were so severe at the time she was "confined to a wheel chair and walker"

Palomino hopes the charge the driver faces is enough for everyone to think twice.

"Don't do it.  Just drive and pay attention to the road," urges Palomino.

The driver who caused the pile up is out on bond.  If convicted on the charge he could face up to three years in prison.
