Former justice unsure when Supreme Court would take up Act 10 ruling

MADISON- It may not be long before the state Supreme Court takes up Governor Walker's collective bargaining law, according to a former Wisconsin Supreme Court justice.

"I strongly suspect the Supreme Court will take this case, I'm don't know at what point," said former Wisconsin Supreme Court Justice Janine Geske.

For the second time in as many years, the collective bargaining law could be in front of the state's high court after a Dane County judge ruled it unconstitutional on Friday.

Geske said the first step is for Attorney General J.B. Van Hollen to ask for a stay of that judge's decision.  "I will be very surprised if a trial court or an appellate court does not stay the order," said Geske.

Requesting a stay in this case is asking for the court to not enforce the finding of unconstitutionality until the appeals have had a chance to run their course.

Currently the law remains in effect for state workers, but not for city, county and school employees.
