Wanggaard considers lawsuit in Racine Senate recall recount

RACINE - The Racine state senate recall race may not be settled just yet. 

Former Racine GOP State Senator Van Wanggaard, who lost to Democratic challenger John Lehman by about 800 votes, may have a new move in store.

Wanggaard said he was to announce on Tuesday whether he will file a lawsuit to challenge the recount numbers. 

He told Newsradio 620 WTMJ's "Midday with Charlie Sykes" his camp was seeing same day registration forms that may be invalid.

"We're hearing there could be thousands that potentially should not have been voting or should not have been given ballots," Wanggaard told Sykes.

"We know they were accepting things such as coupons in the mail, occupant water bills and those types of things, and even written rent receipts signed on the same day of the election."

The recount simply re-tallied vote totals. 

If Wanggaard files a lawsuit, a judge could either toss the election results and call for a re-vote, or order a draw down in districts with irregular votes.

Newsradio 620 WTMJ has asked for comment from the John Lehman campaign.
